Child Custody Move-Away in Carlsbad

Navigate a Move-Away Dispute with 20 Years of Family Law Experience

A move-away dispute arises when relocating a child would affect an existing or proposed custody and parenting schedule. At Davison Family Law, we represent parents seeking to relocate and parents concerned about preserving their current relationship and schedule with the child. We address the effects on travel, each parent’s time, and the child’s daily life.

California family law is Attorney Sara Davison’s sole focus. We serve Carlsbad and North County families navigating relocation requests and changes to existing custody orders. These cases require careful analysis of the child’s relationship with each parent and how distance could alter it.

California Move-Away Standards for Carlsbad Parents

California Family Code section 7501(a) recognizes that a parent entitled to custody may change a child’s residence. The court may still prevent a move that would prejudice the child’s welfare or the other parent’s rights. The applicable analysis depends in part on the current physical-custody arrangement.

Under In re Marriage of LaMusga, when a parent with primary physical custody under a final order proposes to relocate, the other parent initially must show that the move would be detrimental to the child before the court reconsiders custody. This framework doesn’t decide the outcome by itself. The court evaluates potential detriment based on the family’s circumstances and the child’s needs.

When parents share joint physical custody relatively evenly, the court instead conducts a fresh best-interests analysis. California custody policy favors frequent and continuing contact with both parents when that contact remains consistent with the child’s best interests.

Factors in a Child Relocation Decision

A court considers the proposed move through a holistic best-interests analysis, not a checklist in which one factor automatically controls. LaMusga directs courts to examine stability, existing family relationships, and the practical consequences of changing the parenting plan.

Relevant considerations may include:

  • Stability and continuity: The child’s interest in maintaining an established custodial arrangement.
  • Distance and age: The length of the proposed move and the child’s developmental needs.
  • Parental relationships: The child’s relationship with each parent and the extent to which the parents currently share custody.
  • Communication and cooperation: Each parent’s ability to communicate, cooperate, and place the child’s interests first.
  • Practical effects: The impact of distance on parenting time, travel, exchanges, school, and the reasons for the proposed move.
  • The child’s views: A mature child’s preferences may be considered. Under Family Code section 3042, a child age 14 or older generally may address the court, with those preferences receiving due weight.

How We Prepare Child Custody Move-Away Cases

We begin by understanding the child’s needs, the current parenting arrangement, and what the proposed relocation would change. We then gather the records and practical details needed to assess the request and any proposed objection.

Our approach includes:

  • Reviewing the current order: We examine physical custody, the parenting schedule, relocation notice provisions, and any other terms the move could affect.
  • Documenting the practical impact: We organize information about schedules, schooling, and health needs to show how the current arrangement works and how distance could affect the child and each parent’s time.
  • Exploring negotiated terms: When appropriate, we pursue parenting plans that address travel, exchanges, parent-child communication, school breaks, and other distance-related arrangements.
  • Preparing for court: If negotiation or mediation doesn’t resolve the dispute, we maintain organized, trial-ready files and prepare the case for litigation.

Attorney Sara Davison is Certified in Dispute Resolution through the Strauss Institute for Dispute Resolution at Pepperdine. Her formal training informs our use of negotiation and mediation when those methods fit the circumstances. We stay directly involved, explain the strengths and weaknesses of each case, and keep clients informed about what’s happening and what comes next.
